Terms and Conditions

At Hill Farm Finest our aim is to give you the best experience. Please ensure that you have read the following terms and conditions carefully before using our services. They set out what you can expect from us and the terms on which you agree to be bound as and when you place your order.

1. BECOMING A CUSTOMER

1.1 To place an order with us, you must be over 18 years of age, require delivery in our area and have a credit or debit card acceptable to us in your name.

1.2 We reserve the right to decline any order or to suspend your Account with us at our discretion.

1.3 Our Terms and Conditions will apply when you place your order.

2. YOUR ACCOUNT

2.1 If you wish, you may set up an online account with us to make each visit to our website easier. If you do this, you will be given a user name and a password to use each time you place an order with us.

2.2 You are responsible for all activity on your account. You should ensure that your username and password are known only to you and that access to your computer is restricted to prevent any unauthorised use of your account. You must inform us immediately if you believe your password has become known to anybody else or has been or may be used in an unauthorised manner.

2.3 Please ensure that the information you provide us with is correct and up to date and notify us as soon as possible of any changes.

2.4 Please ensure that you have read our statement on our privacy policy.

3. CONTRACT

3.1 This website is operated by Hill Farm Finest. Once you have placed an order on the website we will confirm your order by sending an email to the email address you have provided. This email will list all products you have ordered, the price and delivery details. This is not an acceptance by us. A legally binding contract will only arise once we have completed delivery of the goods to you.

3.2 If you have entered an incorrect email address and receive no email purchase confirmation and/or any other details are incorrect then the responsibity  is on you to contact us to amend your details and we can not be held responsible for the entering of incorrect information or your email service provider spam filtration.

4. AMENDING OR CANCELLING THE CONTRACT

4.1 The confirmation email we send will set out the latest time that you may amend or cancel your order, being within 24hrs of placing your order (the “cut-off time”). Please note that during our festive despatch period (15th December- 31st December each year) (the “festive cut off time”) you must provide us with 24hrs notice after placing your order should you wish to amend or cancel your order. This also applies to Eid ul Fitr and Eid ul Adha.

4.2 Should you wish to cancel your order after the cut off time or after the festive cut off time but prior to delivery, we may charge you in full for an amount equal to the value or your order, including any delivery cost.

4.3 Any cancellation must be sent to us by email to [email protected] within the cut-off time or festive cut off time.

4.4 Where you order goods that are unavailable for any reason, we shall notify you and we will either send a replacement product with your order with agreement from you , or organise a full refund or a voucher within two working days again with your agreement.

5. SUBSCRIPTIONS

5.1 When signing up to our monthly subscription serve you must supply us with accurate and complete information including payment details and related contact and other information.  It is your responsibility to update and maintain changes to that information through your use account.

5.2 Contract with Hill Farm Finest – By submitting your payment and other subscription details you are making an offer to HFF to buy a subscription and you are requesting and agreeing that we may start your subscription immediately upon our acceptance of it (which means that you are not then entitled to a refund if you change your mind after we have provided you with access to your subscription). Your offer will be accepted by us and a contract formed only when we have verified your payment details at which point we will confirm your subscription (by sending you a confirmation email to the address you have given us) and provide you with access to the relevant HFF Materials for your subscription. HFF reserves the right to reject any offer in its absolute discretion. Minimum term for subscription is 12 months via direct debit.  The monthly charge will be £10.

5.3 Payment details – When you are subscribing, you must provide us with complete and accurate payment information and details including your geographical location. By doing this, you are representing to us that you are entitled to purchase the subscription and to use such payment information and details in order to pay for it (and for us to take such payment) throughout the period of your subscription. You repeat this representation to us when, during the period of your subscription, you need to update your payment details where, for example, your card or other payment method expires or when you change your geographical location. If you are entitled to a refund under these terms and conditions we will credit that refund to the card or other payment method you used to submit payment (unless it has expired, in which case we will contact you). If at any time we do not receive payment or your payment authorisation subsequently expires or is cancelled, we may immediately cancel or suspend your access to HFF

5.4 Price – The price you pay for your monthly subscription  (and the currency in which you pay) will be stated on the relevant web page of the HFF website or other HFF online resource from which you begin the subscription ordering process. Such price will be re­confirmed to you as part of the ordering process. It is your responsibility to pay any charges that might be applied by your bank or payment provider in paying for your subscription, including in relation to any currency conversion required. Subject to these terms and conditions, in return for us making the relevant HFF products of your subscription available to you, you agree to pay the subscription payments notified to you at the time you purchase your subscription. We will notify you in advance of any increase in the price of your subscription and you may of course exercise your cancellation rights (see section 10.7 below) if you do not wish to pay the new price.

5.5 Incorrectly stated prices – While we try to ensure that all prices we display and quote are correct and accurate, errors may occur and, if they do, we will notify you of the mistake. If we incorrectly state a price, we are not obliged to provide you with a subscription at that price. If we do notify you of such a mistake, even after having accepted your offer to buy the subscription at the incorrect price, you may either pay the correct price or you can cancel the subscription (in which case we will then refund any money you have paid us that relates to the unexpired portion of your subscription). If you do neither of these things then we shall be entitled to cancel or suspend your subscription.

5.6 VAT (or other sales tax) – Unless otherwise indicated, the prices we state for our subscriptions are inclusive of VAT (or other similar sales tax)

5.7 Monthly subscriptions – If your subscription is monthly it will continue unless and until you provide us with not less than 14 days’ notice prior to the end of the subscription which will be a minimum of 12 months and will include 12 x monthly payments of £10 per month.  If you do wish to cancel your subscription, in which case your subscription will expire at the end of that last month of of your contract. We will notify you at least 28 days in advance of any change to the price of your monthly subscription that will apply upon your next monthly renewal.

5.8 Term – The minimum period of for a subscription is 12 months and will include 12 x £10 payments to be paid on the same date of each month.  Your subscription will renew automatically after the last of your 12 payments has been made.  If you wish to cancel your subscription after that period we will need a notice of 14 days prior to the next payment being taken.  You must email your desire to cancel to the following email address. (Please refer to 10.8)

5.9 Cancelling a Subscription

5.9.1 Cancellation by you – Unless specifically provided for in any other provision of these terms and conditions, your subscription may only be cancelled by you with effect from the expiry of your then current subscription period, and you must do this in accordance with the part of section 2.6 that applies to your subscription. You may provide us with more notice than is required to cancel your subscription, but it will not take effect until the end of your current subscription period. You can cancel your subscription by contacting us at [email protected] stating that you wish to cancel your subscription and including in your email your name and subscription reference number(s).

5.9.2 Cancellation by Hill Farm Finest – Hill Farm Finest reserves the right to suspend or cancel your subscription where this is expressly stated in these terms and conditions and otherwise:

(a) with or without notice and without further obligation to you if you breach these terms and conditions;

(b) where we are prevented from providing HFF products to you by circumstances beyond our control; and/or

(c) where we cease to provide (or to be able to provide) HFF products to which you have subscribed (including where we cease producing the relevant HFF products or no longer own such HFF products or have the right to make them available), or we cease to provide subscription services. Except where we terminate as a result of your breach of these terms and conditions we will, unless there are exceptional circumstances, refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription.

5.10 Your subscription is personal – Your subscription is personal to you and you may not share with, nor give, licence or transfer to, any other person any of your rights or entitlements under these terms and conditions (including to access and/or use HFF under your user account using your password and/or user code). You agree to take responsibility for all access to and use of all HFF website that occurs under your user account and to prevent unauthorised use of it. Without further obligation to you, we may cancel or suspend your access to HFF if you share your user account details. If you believe that your user account is being used by anyone else you should inform us immediately via [email protected]. We reserve the right at any time to verify and/or validate that you are a personal subscriber to our products and that you are accessing.

5.11 Next day delivery – Subscribers will be able to order for next day delivery.  In this instance the order must be received no later than 9am of the morning of placing your order for next day delivery.  If anything is unavailable you will be informed by one of our team and alternative solution will be provided with agreement from you the customer.

5.12 A fair usage policy will apply on a monthly basis with a cap of £500 of order in any one month   There is no limit to the amount of orders that you can place per month.

5.13 Delivery cost – There will be no delivery costs for any orders over £75.

5.14 Discount – Subscribers will be eligible to 10% off everything on our Website (www.hillfarmfinest.com).  We do reserve the right to revise these terms at any time.

6. PRICE AND DELIVERY CHARGES

6.1 The price of the goods will be as quoted on the website at the time you confirm your order by clicking “Checkout” and will be inclusive of VAT (if applicable) or any other tax and, subject to paragraphs 5.2 and 6 below, delivery.

6.2 The delivery charge applying to your order shall be set out at the time you checkout. No delivery charge shall be applied to orders with a value of £75 or more (except during our festive despatch periods listed above 4.1); orders below that value shall be subject to a delivery charge of £9. During our festive despatch there will be an additional premium delivery charge on deliveries during the 15th-31st Dec period.

6.3 If you amend your order prior to the cut off time to increase the quantity of items already ordered, the price charged for the additional items will be the price quoted at the time you made the original order. If, however, you are adding new items to your order, the price charged will be the price quoted at the time you amend the order. The delivery charge shall be amended and applied in accordance with paragraph 5.2.

6.4 We will debit the total cost of your order, including any delivery charge or packaging cost that may be applied, from your debit or credit card at the time you place your order.

6.5  As all items are priced on weight at the time of checkout the price applied will be as per your order.  However, whilst processing the weight of the products may be more or less than the requested weight.  In this case you will be notified prior to despatch by your preferred method text or email to take further instructions.

7. DELIVERY

7.1 We will always aim to deliver your order within three days of the time you place your order as long as we have your desired product in stock, unless your order is placed on Thursday, Friday or Saturday in which case your order will be despatched on Tuesday of the following week.

7.2 If you would like to collect your order from the farm then that can be arranged by selecting ‘Collection from farm’ as your delivery option on Checkout. Usual opening hours apply and we need 48hr notice of your order. Orders have to be collected within 48hrs of collection date; our Logistics team will inform you of the collection date and time. Collections are Monday to Thursday only. The orders have to be collected at the agreed time.

7.3 If nobody is available at your given address nominated by you at the time you placed your order our courier will leave your package and notify you by text that the parcel has been delivered. We will not be responsible if anything happens to your order once the message has been sent.

7.4 Our deliveries are made with “no signature required”. In the event that nobody is available to take delivery of your order at your delivery address or you ask us to leave your goods unattended at a secure place, Hill Farm Finest expressly disclaims all liability that may arise in consequence of the delivery being left unattended, including, without limitation, theft, tampering or contamination, however caused.

7.5 When placing your order, if the incorrect shipping address is entered we will need to be notified by email ([email protected]) no later than 24hrs after placing your order. We will not be liable if your package is delivered to the wrong address or goes missing. Once your parcel has been delivered and left in a safe place we will not be responsible for any issues thereafter.

7.6 If your delivery is refused or not accepted at a recipients address, we can not take responsibility for this and can not offer a free replacement box.

7.7 We can ship produce internationally but any risk, damage or loss of goods shall pass to the purchaser immediately upon despatch of the delivery from Hill Farm Finest. On any international order the courier charge is dependent on the recipient country and you will be advised of the courier charge.

7.8 On domestic deliveries there may be an additional courier charge of £2.95 per additional parcel for order consignments of 3 or more parcels at the same time. Please note that for Ireland and the Highlands this courier charge will be £5.95 per additional parcel.

7.9 Events outside our control, for example, extreme weather conditions, may occasionally mean we are unable to deliver your goods at the time agreed. In these circumstances, we will contact you as early as possible to rearrange the delivery time. In such an event, our liability to you shall be limited to the price of the goods ordered and the cost of delivery.

8. IF YOU ARE DISSATISFIED

8.1 We are committed to offering you the very best service and the very best produce and we guarantee the quality of all goods and produce you order from us. You must inspect the goods immediately upon delivery and, in the event that you are dissatisfied in any way with either our service or the quality of the goods you receive, let us know within 12hrs, in writing, via email ([email protected]) or via the form on our “Contact us” page on our website.

8.2 Complaints in respect of service will be reviewed by our customer services team and we promise to respond to you within 1 working day whenever possible.

8.3 Complaints in respect of the quality of the goods you receive will be forwarded to our Developmental Chef for review. Please therefore retain produce for review, and we promise to respond to you within 1 working day whenever possible with our findings.

8.4 Unfortunately, we are unable to accept the return of any produce delivered to you but, if the goods ordered by you do not meet your reasonable satisfaction, we may, in our absolute discretion, send you a Hill Farm Finest voucher or a full refund to the value of the goods that have fallen short of your expectations within 3 working days of a complaint being received.

9. WHAT WE WILL NOT BE LIABLE FOR

9.1 We will not be liable for any indirect or consequential loss or damage of loss of profits arising out of our supply or failure to supply the goods to you.

9.2 Nothing in this Agreement shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence nor limit any legal rights you have as a consumer.

9.3 Some of our products may contain traces of nuts and other allergens. We will ensure that the contents of each box are clearly listed on our website but it is your responsibility to ensure that you have read the information. If you require further information on allergens, please contact us.

9.4 The goods are sold to you on the basis that you are a consumer therefore we will not be liable for any special losses that you might suffer using, distribution or reselling the goods as part of a business.

9.5 We shall not be liable for goods once they have been delivered to the address or secure place stated in your order.

9.6 Our packaging is designed to ensure our produce reaches you in perfect condition but it is your responsibility to ensure that all perishable goods are refrigerated as soon as possible upon receipt. Further, if you or a third party moves, transports or delivers the goods to any other address following our delivery, we shall not be liable for anything that that third party might do to the goods or any subsequent deterioration in the produce

9.7 Due to the nature of certain artisan products the minimum and maximum weight cannot always be guaranteed. Our products may not always meet the exact criteria within our store. We will not except liability for under or over weight products, the published price is the unit price. We will however always endeavour to meet weight expectations.

9.8 Please note that we will do our best to ensure that access to our website is uninterrupted and that transmission are error-free but, given the nature of the internet, this is not something that we are able to guarantee. There may be occasions where access is suspended or restricted so that we can undertake repairs, maintenance or improvements. We will keep such occasions to a minimum and endeavour to restore full access as soon as we can.

10. GENERAL

10.1 These terms and conditions set out the entire agreement between us. Any failure by us to enforce any of our rights under this Agreement shall not prejudice our entitlement to rely on any of our rights in the future.

10.2 We shall not be liable for delays or failures to perform our obligations if that delay of failure arises from events beyond our reasonable control.

10.3 We reserve the right to change our website, policies and terms and conditions at any time but this shall not affect the terms and conditions prevailing at the time you make a purchase.

10.4 Whilst we take the utmost care to ensure that all product descriptions, images, information and prices are accurate, we do not accept any liability for any inaccuracies, errors or omissions. Colour and shape may vary from those shown on the website.

10.5 This Agreement is governed by the laws or England and Wales and both parties hereby submit to the exclusive jurisdiction of the English courts.
